Terms and Conditions of Hire
The following terms and conditions apply whether or not a contract of carriage has been entered into as a quotation being offered or whether a contract has been made verbally or in writing.
Byeways Vintage Bus Hire is a trading name of Marshopper Ltd., referred to as “the company”.
1 A non-refundable deposit of £200 must be made at the time of booking. The balance of the agreed price must be made 14 days prior to the date of travel by cleared funds in the company’s bank account or by cash. Payment may be in pounds sterling or euros (by arrangement).
2 Any alterations to the hire must be mutually agreed by both parties. The full hire fee will be charged if a booking is cancelled within 14 days of the date of travel. Any additional distance or times will be charged accordingly.
3 The hirer is responsible for the behaviour and actions of all passengers on board the company’s buses. If the hirer is not travelling with the bus, a representative must be appointed and the company informed before the journey is undertaken. The company will only accept instructions from the hirer or their representative.
4 Vehicles are hired subject to availability at the time of booking. The company reserves the right to hire another vehicle from another operator without notice to the hirer; to provide a larger vehicle than that ordered at no extra charge to the hirer; to alter the type of vehicle ordered.
5 In the event of national emergency or force majeure or any unforeseen or unavoidable shortage of drivers or vehicles, the company reserves the right to cancel any booking without liability to the hirer.
6 Refreshments may be consumed on the vehicle by prior arrangement with the company. The hirer will be responsible for any additional cleaning charges caused by spillage of food or drinks onto seats or the fabric of the buses. Glass utensils must not be used whilst the vehicle is in motion.
7 All personal effects and luggage are carried entirely at the owners’ risk. The company’s buses do not lock and are not always attended whilst waiting at venues. The company reserves the right to refuse to carry any item it considers dangerous or unfit to carry on its vehicles. Gangways and exits must be kept clear at all times. Please note luggage space is very limited on historic buses and hirers are advised that not more than 2 folded buggies or pushchairs may be carried. Buggies and pushchairs must not be allowed to remain on the platform of open platform buses unless they are folded and will fit in the luggage space under the stairs, nor must they be allowed to block gangways.
8 The driver or conductor is responsible for the safety of the vehicle and may remove from the vehicle any person whose conduct is in breach of statutory regulations. The hirer will be held responsible for any damage caused to the vehicle by passengers during the hire.
9 The most suitable direct route will be taken to and from a destination unless prior arrangements are made. The hirer will be responsible for any parking, ferry, toll or admission charges. Unless otherwise arranged, the hirer must keep to the arranged times. The driver is obliged by law to obey the various drivers’ hours regulations. The driver has sole discretion as to the suitability of roads and routes to be taken No liability can be accepted if a vehicle is unable to complete its journey due to the unsuitability of a road or location. Passengers may not be picked up or set down where that is prohibited.
10 The company gives estimated journey times in good faith. If for any reason the journey takes longer, the company will not be liable for any loss, damage or inconvenience suffered by the hirer or his passengers as a result. The company will not be held liable for delays caused through unpunctuality, traffic delays or mechanical breakdown. The company will not be liable for any claims beyond the value of the vehicle hire. The company reserves the right to withdraw any vehicle if the hirer or their group are more than 15 minutes late for the requested time; no liability will be accepted for the cost of alternative transport.
11 Any complaints regarding the hire of services provided by the Company must be made in writing no later than 14 days from the date of travel.
12 DISABLED ACCESS The Company specialises in the hire of vintage and historic vehicles. . Whilst the company welcomes persons with disabilities to travel on it buses and will make every effort to accommodate disabled persons and their foldable wheelchairs or other assistance devices. please note the buses are NOT wheelchair accessible. Passengers must be able to climb high steps to board and alight and must occupy one of the fixed seats. The company cannot accommodate non-folding wheelchairs or electric wheelchairs.
